Simple rent and possession claim if the tenant is still in the unit. if not, small claims court.

In most states you must get them served with the subpoena to appear in court to get a judgment for money. You can get an eviction in most with a simple posting of the subpoena or notice to appear.

You can report it, just find the housing department in your area and they should be able to put you in the right direction. 1st step though is not allowing it, over 30 days late with us and they are served with a demand for possession letter (pick up at your local courts) and go after Non-payment of rent. At the 2 month mark you should be rid of them and on to suing for past rent and damages. NOTE EVERYTHING! Photos are a god-send!

Getting back at them is a temptation that you probably shouldn%26#039;t waste your time on. If you go to small claims court and get a judgement against them for the unpaid rent, that will show up on their credit report. Judgements typically have to be paid before they would be approved to finance nearly anything. In the meantime, evict them and learn from the experience.
