I just received a letter from a collections agency. I contacted them and they said that if I paid the debt in full and within 30 days, that it would not show up on my credit report at all.



Does the debt collection agency have any LEGAL obligation to NOT report the debt to the credit bureaus if I pay it off within 30 days of receiving notice?



Or, If they don%26#039;t have any legal obligation to do so, is it standard industry practice not to do so anyway?



I would pay this debt off in full if I could be legally guaranteed that it wouldn%26#039;t show up on my report a few months later anyway.



My only goal here is to protect my credit as best as possible. At the time the debt was accumulating I had no way to pay off the money. I now have the means, but figure if my credit has already taken the hit then I might as well at least keep my money....



So, is my credit ALREADY marred?

Delinquent payments are usually on your credit report before they%26#039;re sent to a collection agency. That%26#039;s bad. If a collection agency makes an inquiry to a reporting bureau, it stays on your record for many years. That%26#039;s worse.

If it%26#039;s already hit your credit report and you pay it , then the report wl be updated to paid late which is better than never paid. If this is your first letter it will not show up if you pay in 30 days. I would also ask them to send me a signed letter stating it is paid off and they will not turn over to credit bureau. Then I would call the original company and get a letter from them stating it is paid off. Oh, ask for a payoff confirmation number and the person%26#039;s name you are talking to. Document everything and save all this information just in case it pops up later. You can use it to dispute it through the credit bureaus. There%26#039;s no obligation for a debt collector to not report it.



Chances are the debt is already on your report, and if it has been deemed a charge-off, the DC cannot report it again. It can only report new information.



If the debt has been sold to another, and the debt has been reported to the credit bureau, it is still the same debt and can%26#039;t be reported again. Once again, only new information can be reported.



You have 30 days from when you receive notice to dispute the debt. It is important you do so, even if you owe. They will have to provide proof of the debt and this is to your benefit, if they decide to sue you. If they don%26#039;t provide the info and sue you anyway, they are in violation of the law and you can sue them.



If they check and can%26#039;t provide proof (maybe they lost it) then legally they are supposed to remove the debt from the report altogether.



But, if they have the proof, they can leave it there.



You can negotiate how much you will pay and what the conditions are. So, you can negotiate possible removal of the debt altogether from your report, or just make the report less harsh. Do this in writing.



Depending upon how old the debt is, it may be legally uncollectable. However, your making a promise to pay will renew the clock, so never make a promise to pay unless you actually will and/or want to. Just saying %26quot;I%26#039;ll pay you the debt%26quot; on the phone is a promise. Saying %26quot;I might consider paying you the debt%26quot; is not a promise.

Here%26#039;s the deal. I used to work in credit and collections, so i think I know something more than these other people that are only guessing...



PAY THE BILL. Your late payment or non-payment will indeed show on your credit report. But, there will be updates to the report that will show that you...



A) Eventually paid the entire balance, albeit late.



B) Paid very very late.



C) Never paid at all (total deadbeat int he eyes of other creditors).



The best thing you can do to save your credit is to pay what you owe. That way, your credit resport will be updated to show (A) that your account was sent to collections but you paid in full. That%26#039;s much better on your credit report than (C) where you never paid the overdue balance at all. If you do that...then you%26#039;re really screwed.

your 1st priority is cleaning up your credit file as that may have a wider impact on your life than just 1 loan.



you should dispute,immediately, all accounts that are not yours with all 3 bureaus. use www.annualcreditreport.com for each bureau and follow their dispute procedures.



Unfortunately as you share the same name as your father, you have a darn near permanent appointment with each bureau every year to clean up your credit report.

Be sure that the DLA dates (Date of Last Activity) are accurate. The CRAs generally remove the items during the three months prior to the seven year mark.



If the account(s) has/have been re-aged, meaning a collection agency is showing a different DLA date, then you will have to pursue them to get the reported dates corrected.



I would send a letter to the CRAs now, just mentioning that you believe the accounts in question are more than seven years in age, and ask them to verify the accounts with whomever is reporting them. If they cannot verify that the accounts are newer than that, then they must remove them, generally, within 30 days.



You don%26#039;t need to write a fancy letter. Just include your name, address, date of birth, and social security number, along with the reporting party%26#039;s name and account number of each account you would like removed, and the reason that they should be removed (too old).



Keep it simple. Simple letters are often more effective than complex diatribes (like this one). :-)

Derogatory Accounts - 7 years from the date of original delinquency;

So, regardless of how long a creditor waits to charge off, sell or transfer a debt, they must report the true and correct %26quot;delinquent or last missed payment%26quot; date (month and year) that preceded the creditor%26#039;s action.



Check your credit reports, they will list the date that the entry is scheduled to be removed. Keep an eye on your reports. If they fail to remove them (which does happen on occasion) then notify the CRA.



Some creditors will re-date a debt to keep it on ones credit report, this is ILLEGAL as per 15USC1681s-2] 搂 623. Responsibilities of furnishers of information to consumer reporting agencies



Watch for re-dating of those debts.

Credit bureaus have been around for quite a while. When they first started decades ago people would actually snoop around and ask your neighbors about your behavior. The meaning of credit is based on your %26quot;character and behavior.%26quot; Nowadays there are 3 main credit bureaus which are Experian, Transunion and Equifax (some regions it could be called by it%26#039;s subsidiary). They are NOT owned by the government in any way, only government regulated. These bureaus collect information from creditors and see how your spending behavior is based on credit that you have received. Based on that they use a special algerythym to calculate a score for you. Which is your credit score. That is why when you are young you have a low credit score b/c you do not have much to base things on. Financial institutions will %26quot;judge%26quot; you based on these numbers and deem if you are able to pay them back. The only main thing there are nowadays is the FCRA to protect you.

All I want to know is that if these collection agencies are allowed to put this on my credit score because it is something that I had no control over...IT HAD TO BE DONE. 1) A reduction in the total bill.

3) Agreement that they will contact the credit reporting agency and advise them that you have negotiated new payment terms and requesting they delete the negative information. Sorry to hear about your situation. The first thing to know is that if it is on your credit report, it is there for 7 years and no matter what you do, it will stay there.



The second thing is that every time you make a payment, the 7 years starts all over.



Call the hospital and see if they will agree to remove the collection and negative entry from all three credit bureaus in exchange for a payment plan. If so get the agreement in writing.



If not, leave the debt alone and stop making payments. (Everytime you make a payment the 7 year cycle starts again, so you are continuing to hurt your credit score.) The negative entry will age and the negative effects on the credit score will start to go away after a couple of years.

I called CA1 to request info on this account and was told that it had been sold and to whom. I them called the new company, CA2, and after receiving an agreement in writing that they would not report, paid them off in full.



Since CA1 no longer owns this account, does this *have* to be deleted when I send in my request to the credit bureaus?

I%26#039;m guessing who you are calling CA1 is the original creditor and CA2 is the collection agency - since two collection agencies cannot legally report the same account at the same time.



Like the first poster stated, the original creditor has the right to keep reporting for the full 7 years. (but not from last activity, it would be 7 years from the first time you became 30 days late and never brought the account current leading to the charge off)



BUT, if both the original creditor and the collection agency are reporting, the original creditor MUST show a zero balance.



If the collection agency is still reporting and the original creditor is showing a balance, send a dispute to the credit reporting agencies on the original creditor.



If the original creditor is reporting any other inaccuracies, you have the legal right to dispute those also.

As long as the second and third CA1 are not legally known as collection agencies and the only one to actually charge off the account was the third CA1, then they would all be considered original creditors.



If that is so, then %26quot;all%26quot; of the CA1%26#039;s can legally have tradelines on your credit reports (as long as %26quot;everything%26quot; they report is reported correctly).



If the second or third CA1 purchased/was assigned the account %26quot;after%26quot; a charge off (or one or both are legally know as a collection agency) that would make one or both of them collection agencies, not original creditor(s)



If that is so, then one or both of them cannot legally have tradelines on your reports at the same time as the CA2 collection agency.

No it will remain on your report for 7 years from the date of last activity on your account, that is a payment or charge. The company did charge it off so it is a valid reporting and can not be removed.



When CA1 charged it off they leagally no longer owns the account and you have a 0 balance with them so there is nothing to report as paid on full on. However, once you pay off the collection account it should be noted as such for CA2. Sometimes it is possible to talk to CA1 and have them remove the negative remarks, but that is really rare and they probably will not do it for you.

this is a trick they try that is common... and illegal. check these links that will explain what to do as well as provides a sample letter to send.



1) run a free credit report from each agency (your allowed one free one per year, per agency). you need to know, so you need to get them.

3) some states allow you to %26#039;lock%26#039; or %26#039;freeze%26#039; credit reports; to protect against theft. if your state allows it, lock %26#039;em down. that way, no one can open an account on them.

They really can not do much. Tell your relatives to say you move to California and they never hear from you and if they keep calling they will turn them into the FBI for un-due harassment. The only way to get access to this information for free or as close to free as you can get is by US mail (you will pay postage). If you apply for credit somewhere and you fail to get credit. You will be sent a rejection letter of your failure to receive credit from most likely a sub -contracted company that looked into your credit history. This rejection letter tells you nothing but that you failed to receive credit through the lender because of your credit history. You will then have to contact one of the 3 major credit companies by mail sending them the rejection letter and a letter of your own included with it requesting an explanation of why you were not approved. Then they should send you your credit report or they will be in contact with you to verify your information. I would also request that they provide you with your credit score. They will not give it to you if you don%26#039;t request it. They may even try to charge you for your credit score.



Think of your credit score like you would a grade in school. A teacher calculates grades by taking scores from tests, homework, attendance and anything else they want to use, weighting each one according to importance in order to come up with a final single number (or letter) score. Your credit score is calculated in a very similar manner. Instead of using the scores from pop quizzes and reports you wrote, it uses the information in your credit report.



The number itself can range from 300 to 900. The formula for exactly how the score is calculated is proprietary information and owned by Fair Isaac. Here, however, is an approximate breakdown of how it is determined:



* 35% of the score is based on your payment history. This makes sense since one of the primary reasons a lender wants to see the score is to find out if (and how timely) you pay your bills. YES. Contact the credit bureaus immediately and put a flag on your report about potential fraud/identity theft, because if the person already got your credit card info, it doesn%26#039;t mean he/she won%26#039;t use other numbers or your SSN to open fraudulent accounts in your name. The flag will require anyone opening an account for you to take a second look before granting credit in case it is an imposter.



Hopefully it is just a one time thing, but if they got your info without you losing your card, then you need to suspect them of getting other info as well that they may have just not used yet.

The sad story is the collection agent lied to you (gasp!).



There are only two way a negative item can be deleted from your credit report.



1) The creditor fails to respond to a dispute investigation from the credit bureau.



2) The creditor must delete it himself.



Now that the collection agent has your money, there is very little incentive for them to help you out with your credit. And filing a dispute might work, but if the creditor verifies it you are stuck again.



This is why I tell people they must get the creditor to agree IN WRITING to delete the entry from their report before you pay them a dime. Then, if they don%26#039;t do it (like they are doing to you now) you have recourse to sue them for breach of contract.



Just note that if you send the letter they sent you to the credit bureau, the only thing that will happen is they will change the status to %26quot;paid%26quot; but it will still have negative information in it about late payments, charge-offs and collections.



Try calling the collection agent and see if they will help you. If not file a dispute.

I have not been contacted at my new address or received any mail from them, this may be due to the fact I did not give them my new information. But since they can go through the credit bureaus and contact them.. I%26#039;m sure they can get my new information. But still have received nothing from them.

If you have well documented proof that:



-you did pay the bill



-you did notify them of the error



-you did dispute this with the credit bureau



...then by all means sue them. There is a very specific procedure you need to follow, but if you do it you have a very easy small claims lawsuit, and you will win $1000 for your trouble (plus legal fees).



If you don%26#039;t want to fight this yourself...look in the phone book for a lawyer that specializes in collections. Sure, they work for collection agencies, but these slimeballs will also eat their young, and will take your case. Many are even starting to do it on a contingency basis, where you pay the filing fees and they only collect when you win (because their fees are included in the suit). They see it as easy money.
